These terms govern your use of BoreSheet (the website and the iOS and Android apps), provided by BoreSheet LLC, an Oklahoma limited liability company. By using BoreSheet you agree to them.
BoreSheet is a planning aid for horizontal directional drilling. It produces estimated bore profiles, rod-by-rod tables and related documents from the numbers you enter. It is not a stamped engineering design, survey, or utility locate. You are solely responsible for verifying all inputs and outputs, calling 811 and having all utilities located and potholed as required, following the utility owner's, permit and code requirements, and the safe performance of any work.
We grant you a personal or business, non-exclusive, non-transferable, revocable license to use BoreSheet. Don't reverse-engineer it beyond what law permits, abuse the lookup services (e.g. automated bulk requests), or use it unlawfully. App store terms (Apple's standard EULA, Google Play terms) also apply to the mobile apps.
Your jobs and files belong to you and are stored on your device (see the Privacy Policy). You are responsible for keeping backups; we cannot recover data we never received.
Optional lookups rely on public third-party data (OpenStreetMap/Photon, U.S. Census, USGS elevations, public company websites). That data can be missing, wrong or out of date, and those services may be unavailable. Imported logos and company details are your responsibility to have the right to use.
BORESHEET IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, BORESHEET LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR DAMAGE TO UTILITIES, PROPERTY, EQUIPMENT, LOST PROFITS OR DELAYS, ARISING FROM USE OF BORESHEET. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR BORESHEET IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
You agree to indemnify BoreSheet LLC against claims arising from your drilling work or your misuse of BoreSheet.
We may update BoreSheet or these terms; continued use after changes means you accept them. You can stop using BoreSheet at any time.
These terms are governed by the laws of the State of Oklahoma, USA, and disputes will be resolved in the state or federal courts located in Oklahoma. [DRAFT — confirm county/venue with counsel.]
